Council met in regular session at 7:30 p.m. with Mayor Rick presiding.

Councilman S. Marks asked everyone to join him in a moment of reflection for their own intentions.  The Pledge of Allegiance was recited by all.

Roll Call:  W. Spaugy, p; S. Ross, p; B. Van Dike, p; W. Bauer, p; S. Marks, p; M. Raddish, p; M. Kelly was absent.

Motion by M. Raddish, second by S. Ross to approve the agenda as presented.  Vote:  Unanimous ayes.  Motion carried.

Motion by M. Raddish, second by W. Spaugy to adopt the minutes as presented.  Vote:  Unanimous ayes.  Motion carried.

COMMENTS OF PENDNG LEGISLATION

Mr. Faiss - 4001 Fairfield - wanted to know what instigated the change in the off-road vehicle ordinance.  Mayor Rick responded that the Police Chief and the Law Director went through it and wanted to tighten up the restrictions.  There have been reports of people running them on the road ways and for everyone's safety, they feel this needs to be done.  Mr. Faiss also asked how people would get them from one place to another; W. Bauer commented that a trailer would be the best way to transport them.

COMMITTEE REPORTS

UTILITIES - S. Marks apologized for missing the last work session.  He had nothing else to report.

STREETS - M. Raddish had nothing to report.

SAFETY- W. Spaugy - presenting Resolution 2011-31 for a first reading.

P & Z - S. Ross - there will be no P & Z meeting this month.

FINANCE/AUDIT - B. Van Dike - presenting Resolution 2011-30.

W. Bauer reported that the Council Work Session will be July 27 @ 7:00 p.m.  All committees are on the agenda.

A)  Approval of the 2012 Alternative Tax Budget Information - Motion by B. Van Dike, second by W. Spaugy for the approval of the 2012 Alternative Tax Budget Information.  Vote:  Unanimous ayes.  Motion carried.

B)  Seymour Avenue Reconstruction Project - asphalt vs. concrete.  M. Raddish met with the engineer and Tri-Mor Construction they have convinced us to go with concrete for this project.  They will  give us back the difference between concrete and asphalt, which is about $7000.  This will be handled as a "change order".  Mayor Rick asked what convinced them to go with concrete.  M. Raddish responded that with the amount of school bus traffic and with the ground the way it is, concrete will hold up much better.  G. Hill added that the company specializes in concrete, they have very good ideas for the base which he feels are very good.  The inspector for this job is a previous employee of  Tri-Mor and he speaks highly of  their work.  Mayor Rick added that at first we didn't realize that the majority of the bus traffic does cut down Seymour.

Motion by B. Van Dike, second by  W. Spaugy to approve the payment of the bills as presented on the voucher register.  Vote:  Unanimous ayes.  Motion carried.

OLD BUSINESS - None

NEW BUSINESS

B. Van Dike presented Resolution 2011-30 as follows:

A RESOLUTION TO ACCEPT THE RECOMMENDATIONS OF THE TAX INCENTIVE REVIEW COUNCIL TO CONTINUE THE AGREEMENT BETWEEN THE VILLAGE OF MOGADORE AND RUBBERMAID 2002, IN ACCORDANCE WITH THE ENTERPRISE ZONE REQUIREMENTS SET FORTH IN OHIO REVISED CODE AND DECLARING AN EMERGENCY   

Motion by B. Van Dike, second by S. Ross to suspend the rules requiring three readings.  Vote:  Unanimous ayes.  Motion carried.

Motion by B. Van Dike, second by S. Ross for the adoption of Resolution 2011-30.  Vote:  Unanimous ayes.  Motion carried.

W. Spaugy presented Resolution 2011-31 for a first reading as follows:

AN ORDINANCE AMENDING TITLE VII TRAFFIC CODE:  CHAPTER 75, OPERATION OF BICYCLES, MOTORCYCLES, AND OFF-ROAD VEHICLES OF THE MOGADORE CODE ORDINANCES, ADDING SECTION 75.08 TO ESTABLISH REGULATIONS FOR THE USE OF THESE VEHICLES AND DECLARING AN EMERGENCY

COMMENTS

Jon Mencer - 242 S. Cleveland Ave - asked if the Village could trim the trees that hang over Albrecht Ave. from the Village property.  Mayor Rick commented that he would have the Street Department take care of it. 

Jon Yeargin - 261 Ridge Rd - asked if the Village has heard anything about the sale of the Country Club/Golf Course and what is going on with that.  Mayor Rick replied that no one has requested to be on the P & Z agenda for this month, they would have to wait until August if anyone wanted to be on the agenda.  He has also spoken with the realtor and the realtor said they were having some issues with the seller and that is all he would say.  As far as the Village is concerned it is still for sale and the property is still zoned R-1, residential.  They are paying "commercial" property taxes, but the property is still zoned residential. Mr. Yeargin asked if they came in with 600 jobs to pay income tax to the Village wouldn't they want to change the zoning?  J. Reed stated that there are no proposals on the table and he explained the process they would have to follow for a zoning change and there has been  no company propose any amount of jobs at this time.  Mayor Rick added that there has been no requests for information on incentives or anything from any company at this time.  Mr. Yeargin asked if they have told any of the employees when they will be out of jobs?  Mayor Rick stated that his sister works there and Eric West told her that as of October there would be no more golf.

Being no further business there was a motion by W. Bauer to adjourn the meeting.
