Pending Council Approval SPONSOR: MAYOR RICK A RESOLUTION AUTHORIZING AND DIRECTING THE MAYOR AND CLERK-TREASURER TO ENTER INTO AN AGREEMENT WITH THE COUNTY OF SUMMIT, OHIO FOR THE CONSTRUCTION OF A MUNICIPALLY FINANCED SANITARY SEWER AND DECLARING AN EMERGENCY WHEREAS, the Village of Mogadore has requested permission to construct, at the Village's own expense, a gravity sewer located in the Village of Mogadore; known as the Mogadore Virgil, Eleanor, Charles Sanitary Sewer Extension, project no. Q-950; and, WHEREAS, the County of Summit shall own, operate and maintain the improvement and appurtenances upon completion of the work by the Village and acceptance of the improvement by the County, NOW, THEREFORE, BE IT RESOLVED by the Council of the Village of Mogadore, Counties of Summit and Portage, State of Ohio, that: SECTION ONE. The Mayor and Clerk-Treasurer are hereby authorized and directed to enter into an Agreement with the County of Summit, Ohio for the construction of a municipally financed sanitary sewer, known as the Mogadore Virgil Eleanor Charles Sanitary Sewer Extension, Project No. Q-950, terms and conditions of such Agreement being set forth in "Exhibit A" attached hereto and made a part thereof. SECTION TWO. The Village of Mogadore finds and determines that all formal actions of this Council concerning and relating to the adoption on this resolution were taken in open meetings of this Council and any deliberations of this Council and any of its committees that resulted in this formal action were in meeting open to the public, in compliance with all legal requirements. SECTION THREE. This Resolution is hereby declared to be an emergency measure necessary so as to construct said sanitary sewer extension to coincide with the current the Virgil, Eleanor, and Charles Street Infrastructure Project, and for the public peace, health and safety of the residents of the Village of Mogadore and shall take effect and be in force upon its passage by Council and approval by the Mayor or at the earliest period allowed by law.
